If I am lucky enough I can make upto 70-80years of my age maximum, considering my age now, I might live another 30-35yrs. Just imagine what life we want, I completely agree what points you mentioned below. But you are forgetting the insidents we read in news media every day. I almost find atleast one incident where people are killed just for money........what if our fate is not good, and we encounter such situation???

I am not sure what the writer is trying to say.
In my field we try to hire the best applicant for the job whether American, European or Asian or from elsewhere does not matter. Otherwise you get a bunch that do not know how to convert units and crash things ... let me not name them.
Transfers are for people to change jobs. I have done it. My employer(s) do(did) it all the time.
What do you propose? Keep waiting for green cards 10-15yrs without knowing if it will be approved in the end.
H1B is for labor shortage. If there is an abuse then the govt needs to crack down. If the laws come short, then better laws can be crafted.

Do you not think that these companies are going to pause in filing labors for people going forward due to the additional hassle and the bad publicity if their labors do get denied?

I think it is fair to go by EB level than priority date. Usually the levels mean qualifications. I think they deserve to get GC first! That makes more sense to me.

it's not mine case. Clockwork reported some LUD for I140 some where. May be Aug 5? Not sure. But I think LUD of I140 doesn't matter. This is my personal opinion.

Up until July 29, 2007 (incl.) when sorting of files was going on, NSC did a load sharing of files with TSC. (and btw they did not look at where ones' I-140 is adjudicated when making the selection, it was random. I know several such cases)
This in my opinion is a very good way of making sure adjudicating resources are kept in balance at both centers.
Like somone quiet rightly pointed out it is akin to the old Labor Certification process where some states were way faster than others (less demand faster process).
In the direct filing which started July 30, 2007 the load sharing has a great possibilty of being tilted one way or the other (though maybe not as much as old LC's). They have made a geographical distribution and not one that factors # of applications traditionally received from states.
On the other hand, may be USCIS has figured that the particular geographical jurisdiction produces the right load sharing between NSC and TSC!
CA and NY were the two states which were always backlogged during those bad old days of labor processing. Now, CA application goes to TSC and NY goes to NSC and that might keep both the centers balanced going forward.

I do not understand why people spend their energy in coming up with some lame ideas. Just because you suffer does not mean that your fellows have to suffer, what is the point of being a sane individual with that kind of thought process.
There are people who come here on all kinds of visas F1, H1, L1 and like this country and stay back and need a green card for convenience. Students who came here want priority over people who came on H1B. It makes sense from their point of view.
Similarly people on H1B who got stuck in several stages and had to change the company have their own point of view.
How bout having a lame rule saying that GC for people with I.Q of 140 and above?

How bout having a lame rule like if you have a family you will be penalized by putting you at the end of the line for GC?
The list can go endless..

I am bringing these out not because I am opposed to equal treatment of folks on H1/ EAD etc - but because there are legitimate arguments both ways and unless we can prove unequivocally that there is gross miscarriage of justice in denying us this right and on the other hand - there is no disadvantage caused to anybody else by granting us this right - this idea is unlikely to see the light of the day
while i am happy to be proven wrong - i do not see anyone in this forum having a stomach for a protracted legal battle starting with lower courts and going all the way to Supreme Court - going back to my previous point - we do not see this as a "larger than me" cause
Incorrect words used by me, I did not mean that supreme court gave authority, but that supreme court did not find that discrimination based on country of origin for immigrants violates the basic tenents of this countries constitution.
I am not saying that this is a case on employers. If at all it would be a case against the discriminatory laws of the congress which allow someone to stay indefinitely but, do not allow them to work.
If a case like this is filed, I do not think, I do not see it going to be a proteacted battle. If enough coverage is given, the lawmakers might sit down and fix the problem or atleast have a quick temporary fix. Maybe even lawmakers might not be needed, just the DOJ would might update the rules (which it is allowed in case it determines that the laws are conflicting). Most important of all, this will bring the issues on the front from being a laggard.

there is a definite procedure, we follow it with appropriate paperwork and itll get done.
only thing is after ur date becomes current. YOU may have to WAKE up the application by using lotta phone calls/infopass/congressman etc.
a colleague of mine got this done last year. his case was like this. its eb2 to eb2...but
i think it wud be similar to eb3-eb2

in april, he got appproval for 485, no RFE, card arrived direct in mail.

In that case, I *guess* you can show yourself as "permanently self-employed" for your own company--should be easy if you have an LLC that does business in "same or similar" occupation (e.g., consulting/PM). Should also be easy to state the *projected" yearly income on EVL.

I am not sure why USCIS is publishing the updates every week saying that there is progress in receipting dates.
There are so many of us just in the July 3rd to July 16th range.
I don't get it. :confused:
