    Right, my bad! I was not referring to the Employment Letter for GC job. I was referring to the Current Employment Letter which is not required as initial evidence. Should have clarified.

    So you were not referring to Employment Letter for GC job, rather Current Employment Letter while discussing how to file I-485.

    We're anxiously waiting for the receipt notice in the mail...

    EADplease,

    I called them and reached an IO officer and told her that I see my checks are cashed and there is a receipt number behind the check but its illegible and can she confirm the numbers for me. She asked for DOB, address, full name etc. and then gave me the receipt numbers for EAD, AP and AOS.

    But if your checks are cashed then the receipt notice must be in the mail.:)

    Those that matter and can make a decision will ask just one question.
    "If oldest priority date should be considered then what is the use of categories like EB1, EB2, EB3 etc." ? It is a weak argument to say that we are talking only about spillover visas here.

    Why, indeed, should USCIS give spillover away to anyone? They could as well sell off the excess visas at a premium, can't they?

    I think the admin should respect the wishes of his friends and close this thread, it is causing pain for them.
    If all of us agree that we need to help his family then lets open a new thread and make it about helping them, so his friends do not need to come back here and read his last words over and over again.

    Careful my friend. Porting rules will be as tough as the rules for applying in Eb2. If you make porting difficult, you will set a higher standard for the approval of your application in Eb2 ending up with the possible rejection of yours and other Eb2 applications.

    Why would you want to stop someone eligible to apply in Eb2? If someone has met all the criteria, the same criteria you had to fulfill when applying in Eb2, then what is the problem?

    Consider the scenario:
    Two guys (A and B) come to US in 2005, both do not have MS and experience less than 5 years. Therefore both not elligible for EB2 on 2005. They are from a retrogressed country.

    A does MS and joins job in 2007, becomes eligible for EB2 and files GC on 2007.
    B joins a job on 2005 that do not need MS and experience and files for EB3.

    Till 2010 both of them did not get GC. But B crossed 5 years of experience and from EB3 to EB2. Now B's priority date is 2005, although he was not elligible for EB2 at that time.

    Although A was elligible for EB2 in 2007 earlier than B (2010), A is pushed behind B.

    SHould it be acceptable to people like A? And there is not one or two pleale like B, thousands arer doing that?

    If you see my priority date you will understand I am not saying this for myself. I have a bro and friends who are facing this isssue.

    Therefore EB2s who are from mid 2006 onwards will really get pushed back..

    I see this porting simillar to the labor substitition.. Till it was in place it was legal although thousands bought labors and that is one main reason EB2 had retrogressed back to 2000. I predict simillar thing is happending again, people are paying money to the desi employers to file perm in EB2 again pretty soon same tertrogression will happen to EB2 I if any urgent action is not taken.

    I hace passed this stage.. now its for you all to decide..

    Instead of working on recapture..we must work on filing for 485 even if PD's are not current.. this way.. atleast in this recession ppl can be assured of some piece of mind.

    visa recapturing will not happen..am not being pessimistic..its just too much of a hassle...needs a law and all that.. too complicated.

    allowing to file for 485 can be bought back as a temporary relief..we should work on that!

    Receipt date at TSC: June 18th: Check Encashed.
    Generic sof LUDon all cases 06/06/08- I donot think, EAD paper file could have reached by 06/6/08. - Not sure of why Soft LUD

    July 2nd 07, 485/ap/ead Filer.

    When did u apply for your ead? i am in the same boat and have filed for paper based EAD. hope to get my fp notice soon.

    I applied for my EAD and AP renewal on the second week of May 2008. Again, I am not sure if EAD or AP renewal triggered the FP notice. Good luck to you.

    Thats incorrect...Lot of major corporations hire from different locations in the world...I have several friends working at a s/w giant in Seattle area who were directly hired in Russia, India, Singapore, etc...

    I think that is an exception. Majority of corporations won't hire from overseas.

    I landed in June 2006 in Toronto. If anybody needs information please feel free to ask.

    What documents, applications need to be filled out after we land in Canada; in-terms of applying for the Resident Card, Social Insurance Number etc. I don't even know what else needs to be filled out.

    Can we fill these applications on-line or must be fill them out only after we have landed physically in Canada?

    After landing, how long before we can come back to the USA for resuming our job?

    For those who doubt that a definitive initiative is needed for the Legal immigrant community, may I humbly remind them of the most basic and the most important phrase of the US Constitution..."Every human being has the right to Life, Liberty and the Pursuit of Happiness". What has been happening with all this memos and counter-memos and visa bulletins from the USCIS and the DOS is a denial of our basic human rights...first as Human beings and then as Legal Immigrants. It is not a legal immigrants fault that the US Law does not limit the F1 visas issued in a year by country and the number of jobs applied under H1b program by country. The endless delays in the GC process clearly disadvantages the legal immigrant community from large countries like India and China compared with legal immigrants from other countries and even US citizens. They clearly cannot pursue their dreams of prosperity, career advancement, security (for himself and family via education, jobs and homes) and overall happiness. Justice delayed is nearly always denied.
